Terms and Conditions

The information on this site is provided for use by customers and potential customers intending to purchase training courses via Now Training UK Limited (Now Training) and may be downloaded by viewers and stored in computer caches for use by the person downloading the information only and for the purposes of booking training courses. The material may not be retained for more than 2 hours in a cache, although Now Training makes no restriction of re-loading of caches after 72 hours. Save for indexing of material in bona-fide search engines available to the general public and for bona-fide public news reporting, the information may not be otherwise downloaded or reproduced without the express permission of Now Training. Except for those permissions granted above, the information may not be modified or altered in any way or publicly displayed or otherwise transferred or stored.

PROVISION OF INFORMATION ABOUT COURSES

Now Training is unable to check the accuracy of information provided to it by training course providers and the price of the course booked though the site reflects this. The information about the courses (including if applicable any associated services) is provided on this site by Now Training in good faith and has been provided by the course provider. BY AGREEING TO THESE TERMS, YOU AGREE THAT ANY REPRESENTATION ABOUT THE COURSES IS THE REPRESENTATION OF THE TRAINING PROVIDER AND THAT NOW TRAINING LIMITED DOES NOT ACCEPT ANY RESPONSIBILITY OR INCUR ANY LIABILITY FOR THAT INFORMATION. In the event of any dispute concerning the information provided via the web-site, Now Training's only obligation shall be to provide a certified copy of the information relating thereto as provided to Now Training by the course provider and subject always to the removal of any confidential material by Now Training.

The information on the site may be altered without notice at the discretion of Now Training and it is your responsibility to ensure that you are using the up to date information on the site. In the event that the price or nature of the course changes after you have placed your booking then you will be given the opportunity to cancel the booking and will receive a full refund.

BOOKING PROCEDURE

Your contract will be with the course provider and you agree that, notwithstanding any contrary agreement between Now Training and any course provider, you shall treat Now Training as your agent in facilitating the booking of courses.

Bookings will be accepted online via the web-site (except where otherwise expressly agreed by us). Upon completing the online booking form and clicking the accept button (or sending us any non-online booking), you will be deemed to have read and agreed to accept both these terms and conditions and those of the course provider which are available upon request. Any such booking is provisional and your booking is subject to confirmation by us, payment by you and availability of places.

After we receive your booking, we will process your booking as quickly as we can and provide you with confirmation that we are doing so, within 24 hours. We are not liable for any failure to receive your booking and if you do not receive our acknowledgement of your booking within 24 hours you should contact Now Training again.

Once we have confirmed payment and availability of the course we will contact you again to provide final confirmation of the booking.

BOOKING SUPPORT

Now Training will make all commercially reasonable efforts to provide support facilities (by telephone and e-mail) to assist you in relation to your bookings during normal office hours of 9am to 5.30pm (excluding reasonable lunch periods) Monday to Friday (excluding public holidays).

PERFORMANCE, CANCELLATION, INTERRUPTION

Now Training cannot guarantee the performance or quality or suitability of the course in any way whatsoever and offers no assurance of uninterrupted or error free service or the accuracy, completeness or currency of any of the courses. You agree that in the event of cancellation, interruption or inadequate or non-performance of a training course, your sole remedy lies against the provider of that course in accordance with their terms and conditions and that the price of purchase of the course via Now Training reflects that you have no remedy against Now Training.

WARRANTIES

NO WARRANTIES, TERMS, CONDITIONS OR REPRESENTATIONS, WHETHER EXPRESS OR IMPLIED, OF ANY KIND ARE MADE BY Now Training RELATING TO INFORMATION ON THE WEB SITE OR THE COURSES OR SERVICES WHICH MAY BE BOOKED THROUGH THE SITE EXCEPT AS SET OUT IN THESE TERMS AND CONDITIONS. Now Training EXPRESSLY DISCLAIMS ANY WARRANTIES, TERMS, CONDITIONS OR REPRESENTATIONS (WHETHER EXPRESS OF IMPLIED) WITHOUT LIMITATION (INCLUDING THOSE OF REASONABLE SKILL AND CARE, SUITABILITY, MERCHANTABILITY, FITNESS FOR ANY PARTICULAR PURPOSES OR ANY NON-INFRINGEMENT OF INTELLECTUAL PROPERTY IN RELATION TO THE COURSES).

In relation to courses offered on digital media by Now Training, Now Training warrants only that any and all software (whether in machine readable or human readable form) supplied by Now Training (but not any trainer) in connection with this Agreement (and whether such supply is by physical media, online and/or otherwise) shall conform in all material respects with any specifications and/or requirements relating to functionality, performance and response-times contained in any written material provided by Now Training and relating to such software. Now Training further warrants that physical media shall be reasonably free from defect and in the event that the media is shipped when defective, Now Training's sole responsibility shall be to ensure that a non-defective supply of the contracted-for material is provided. In relation to digital media supplied by the course provider, your remedy shall lie against the course provider as set out in their terms and conditions and Now Training's only obligation shall be to assist you at their discretion in obtaining a conforming copy.

EXCLUSION OF LIABILITY

IN NO EVENT SHALL Now Training BE LIABLE FOR ANY DAMAGES (INCLUDING CONSEQUENTIAL OR INCIDENTAL DAMAGES) WHATSOEVER ARISING OUT OF USE OF THE SITE EXCEPT: a) WHERE Now Training FRAUDULENTLY MISREPRESENTS ANY SUPPLY UNDER THIS CONTRACT, OR b) PERSONAL INJURY OR DEATH CAUSED BY THE NEGLIGENCE OF Now Training, ITS EMPLOYEES OR AGENTS. THIS SHALL BE THE CASE EVEN WHERE Now Training HAS BEEN ADVISED OF THE RISK OF DAMAGES AND/OR SUCH RISK IS REASONABLY FORESEEABLE. YOU AGREE THAT THE PRICE OF THE COURSE REFLECTS THIS LIMITATION.

Your statutory rights are not affected by this agreement.

INTELLECTUAL PROPERTY

Except where otherwise identified the programming and images are the copyrights of Now Training and Now Training Ltd is a registered trademark of Now Training. Other Trademarks of training course providers may also be displayed on the site from time to time. You are not licensed to use any Now Training copyright or trademark material except for booking a course. Course material may be subject to trademark and copyright restrictions imposed by the training provider.

Now Training shall have no liability for infringement of intellectual property relating to the course and shall have the right in the event that it is notified that any course infringes any party's intellectual property to do all or some of the following at its sole discretion: (i) obtain an appropriate right to permit Now Training to continue the distribution of the Training Event, (ii) offer to substitute other Training Events with similar capabilities, (iii) modify the Training Event so that it is no longer infringing, (iv) issue a refund of the applicable purchase price of the Training Event and cancel the Event, and/or (v) remove the applicable Training Event from web-site portal.

PRIVACY

Now Training is registered with the United Kingdom Data Protection Registrar and your personal data is held in accordance with the Data Protection legislation currently in force in England. As part of the booking process, Now Training collects personal data concerning you and your use of the web-site. Now Training agrees not to pass your information on to any third parties, except to the degree necessary to any provider of training events you have indicated a desire to attend and you are deemed by consenting to these terms and conditions to have consented to this exchange of information (which may be an exchange of information outside the European Economic Area). From time to time, you agree that Now Training may provide to your e-mail address details of special offers relating to courses on offer in accordance to traffic-data provided from your use of the site or as a result of your registered details. In the event that Now Training considers it necessary to contact you by e-mail, post or telephone in relation to any booking made by you, you consent that they may do so.

You also consent that we may track your use of the site and use any cookies or personal data for the provision of demographic information of an aggregated and collective nature for our own analysis of training trends, site usage and other similar research and statistics. You also consent that we may share this with third parties in an anonymous format that does not allow you to be identified.

TRAINING PROVIDERS' TERMS AND CONDITIONS

As part of the course booking process you will be required to accept the training providers terms and conditions.

JURISDICTION

This site is controlled and operated from England and the terms and conditions of this site and any dispute about them shall be subject to the application of English Law at all times. In the event that a dispute arises out of or relating to these terms and conditions or the use or access to this site, such dispute shall be brought exclusively in the Courts of the Central London County Court or the High Court of England and Wales, Strand, London.
